Htaccess Lint for JetBrains IDEs — End User License Agreement

This is a proprietary license. Htaccess Lint is not open-source software. The source code is not licensed to you, and nothing in this agreement grants open-source rights.

1. Parties

Htaccess Lint ("the Software") is a plugin for JetBrains IDEs owned by Timothée Aubourg, a French sole proprietorship (micro-entreprise), 72 avenue des Prés Vendôme, 78450 Villepreux, France, SIRET 921 129 334 00014 ("the Publisher"). VAT not applicable, article 293 B of the French General Tax Code (TVA non applicable, art. 293 B du CGI). By installing or using the Software you ("the User") accept this agreement. If you do not accept it, do not install or use the Software.

2. Free features

The Publisher grants you a free, non-exclusive, non-transferable, worldwide license to install and use the free features of the Software, for personal or commercial work, on any number of machines.

3. Pro features

The Pro features are sold through JetBrains Marketplace as an annual subscription per user, with a 30-day free trial. JetBrains processes the payment, issues the invoice, collects VAT and delivers and checks the license, under its own terms of purchase, which also apply. Each license grants a non-exclusive, non-transferable right to one named individual; a team needs one license per user.

While the subscription is active, you receive every update of the Software. When the subscription or the trial ends, the Pro inspections stop reporting; the free features keep working.

4. Restrictions

Except where applicable law expressly allows it (in particular article L. 122-6-1 of the French Intellectual Property Code on interoperability and error correction), you may not:

  • redistribute, sell, rent, sublicense or publish the Software or a license;
  • modify, adapt or create derivative works of the Software;
  • decompile, disassemble or reverse engineer the Software;
  • bypass, disable or tamper with the license or trial check.

5. No warranty

The Software is provided "as is". To the extent permitted by law, the Publisher gives no warranty that the Software is error-free, fit for a particular purpose, or that it will find every error in your .htaccess files. A file without problems reported is not guaranteed to work on your server: hosting configurations differ. Nothing in this agreement limits the statutory rights of consumers, including the legal guarantee of conformity for digital content under French and EU law.

6. Limitation of liability

To the extent permitted by law, the Publisher is not liable for indirect damages (loss of data, profit, business or opportunity, website downtime). The Publisher's total liability under this agreement is limited to the amount you paid for the Pro license in the twelve months before the claim, or zero for the free features. This limit does not apply to gross negligence, wilful misconduct, or personal injury.

7. Termination

This agreement ends automatically if you breach it. On termination you must stop using the Software and uninstall it. Sections 4 to 8 survive termination.

8. Governing law and jurisdiction

This agreement is governed by French law. Any dispute falls under the jurisdiction of the courts of Villepreux, France, subject to mandatory rules that let consumers bring proceedings in the courts of their place of residence.

10. Trademarks

Apache and Apache HTTP Server are trademarks of the Apache Software Foundation. JetBrains and the names of JetBrains IDEs are trademarks of JetBrains s.r.o. The Software is an independent product, not affiliated with or endorsed by the Apache Software Foundation.

Htaccess Lint, plugin pour les IDE JetBrains, appartient à Timothée Aubourg, micro-entreprise de droit français (72 avenue des Prés Vendôme, 78450 Villepreux, France, SIRET 921 129 334 00014). TVA non applicable, art. 293 B du CGI. Installer ou utiliser le logiciel vaut acceptation du présent contrat.

  1. Fonctions gratuites : licence gratuite, non exclusive, non cessible, pour tout usage personnel ou professionnel, sur un nombre illimité de machines.
  2. Fonctions Pro : vendues sur JetBrains Marketplace en abonnement annuel par utilisateur nommé, avec essai gratuit de 30 jours. JetBrains encaisse, facture, collecte la TVA, délivre et vérifie la licence, selon ses propres conditions d'achat, qui s'appliquent aussi. Toutes les mises à jour sont incluses pendant l'abonnement ; à son terme (ou à la fin de l'essai), les inspections Pro se taisent et les fonctions gratuites continuent de marcher. Remboursement intégral sous 14 jours après l'achat, sans condition : écrire à support@timaub.fr.
  3. Interdits, sauf ce que la loi autorise expressément (art. L. 122-6-1 du Code de la propriété intellectuelle) : redistribuer, revendre, partager une licence, modifier, décompiler, contourner la vérification de licence ou d'essai.
  4. Garantie : logiciel fourni « en l'état », dans la limite permise par la loi. Un fichier sans problème signalé n'est pas garanti fonctionnel sur votre serveur. Les droits légaux des consommateurs, dont la garantie légale de conformité des contenus numériques, restent intacts.
  5. Responsabilité : pas de responsabilité pour les dommages indirects (dont l'indisponibilité d'un site) ; plafond égal au prix payé sur les douze derniers mois (zéro pour les fonctions gratuites), sauf faute lourde ou intentionnelle et dommage corporel.
  6. Résiliation : automatique en cas de manquement.
  7. Droit applicable : droit français ; tribunaux de Villepreux, sous réserve des règles protégeant le consommateur (qui peut saisir le tribunal de son domicile).
  8. Sécurité et support : support@timaub.fr ; failles de sécurité : security@timaub.fr, première réponse sous 5 jours ouvrés.
  9. Marques : Apache et Apache HTTP Server sont des marques de l'Apache Software Foundation ; JetBrains et les noms des IDE JetBrains sont des marques de JetBrains s.r.o. Le logiciel est indépendant, sans lien avec l'Apache Software Foundation ni approuvé par elle.

Langue. Les deux versions ont la même valeur. En cas de divergence, l'interprétation la plus favorable à l'utilisateur consommateur prévaut (art. L. 211-1 du Code de la consommation) ; entre professionnels, la version anglaise fait foi.
